Welcome to MyOnboarder. By creating an account, accessing the platform, or using any feature of MyOnboarder.com, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the platform.


These Terms form a binding agreement between you ("User," "Admin," "Company," or "You") and MyOnboarder, LLC ("MyOnboarder," "We," "Us," or "Our").

1. Overview

MyOnboarder provides a cloud-based onboarding, training, and document-simulation platform. Companies use MyOnboarder to onboard and train their internal staff. MyOnboarder acts solely as a technology provider, not an employer, trainer, broker, or legal advisor.


Accounts may be created in two ways:


  • Admins/Company Owners can freely create their own organization account.
  • Users/Staff may only join when invited by a Company.

2. Your Relationship With MyOnboarder

You acknowledge and agree that:

  • MyOnboarder provides the software platform only.
  • Companies are responsible for their own policies, content, training materials, and documents uploaded to the system.
  • Companies manage their own users, including invitations, access, grading, deletion, and permissions.

MyOnboarder is not responsible for:

  • The accuracy or legality of Company-uploaded documents
  • Company policies
  • Hiring decisions
  • Training decisions or outcomes
  • Compliance with local, state, or federal laws applicable to the Company's industry

Hold Harmless and Disclaimer


By using this platform, you acknowledge that all training, tools, and materials are provided for educational purposes only. You are solely responsible for how you apply the information in real-world situations.


MyOnboarder does not provide legal, financial, or professional advice, and does not guarantee outcomes, accuracy, or compliance with laws, regulations, or company policies. You agree to hold harmless and release MyOnboarder, its owners, and affiliates from any claims, damages, or liability arising from your use of this platform or reliance on its content.


You are responsible for verifying accuracy, following applicable laws, and obtaining professional guidance when needed.

3. User Accounts

You must be 18 years or older to use the platform.


You are responsible for maintaining the confidentiality of your login credentials. You agree not to impersonate others or misrepresent your identity.


Companies may deactivate or delete Users within their organization at any time. MyOnboarder may suspend or terminate any account for abuse, violation of these Terms, or nonpayment.

4. Acceptable Use

You agree not to:

  • Upload illegal, harmful, misleading, or copyrighted materials you do not own
  • Attempt to bypass, reverse-engineer, or disrupt platform functionality
  • Misuse AI tools for harmful or discriminatory purposes
  • Harass other users or abuse the platform

We reserve the right to remove content or suspend users who violate acceptable use.

5. Platform Features & Disclaimers

Your use of the following features is subject to the disclaimers below:

AI Roleplay Simulations

AI conversations and personalities are simulated for training only. They may not always be accurate, consistent, or representative of actual human behavior. Any feedback, requests, examples, scripts, or industry descriptions provided by customers to help configure AI characters may be used by MyOnboarder.com to improve the platform and its AI systems without restriction or compensation.

Grading and Report Cards

Scores are automated and for training purposes only. They should not be used as the sole basis for hiring, firing, or employment decisions.

DocuGrader

Document analysis is for training purposes and is not legal or compliance advice. E-signature placements generated in DocuGrader are not legally binding.

Content Hosting (Videos, PDFs, Guides)

Companies are responsible for ensuring their uploaded content is lawful and compliant.

User Analytics, Metrics, and Data Processing

MyOnboarder may process anonymized usage data to improve system performance.

DOCUMENT PREPARATION AND SIGNATURE DISCLAIMER

MyOnboarder provides tools for document preparation, onboarding workflows, and training management only.

MyOnboarder is not a law firm, not an electronic signature authority, and does not provide legal advice, legal verification, or legal certification of any document, agreement, or signature.

SIGNATURE IMAGES AND MANUAL SIGNING

If a company uploads a signature image for use within documents, that image is treated solely as a visual asset applied to documents at the company’s direction.

MyOnboarder does not verify the identity of any signer, validate intent, confirm authorization, or certify that any document has been legally executed.

Any manual signature, typed signature, or signature image applied through MyOnboarder is performed at the sole discretion and responsibility of the customer.

TIMESTAMPS AND SYSTEM METADATA

MyOnboarder may record internal system timestamps related to user actions such as document completion or workflow progression.

These timestamps are provided for internal tracking and workflow purposes only and do not constitute legal execution timestamps, proof of signing, or certification of agreement execution.

CUSTOMER RESPONSIBILITY

Customers are solely responsible for:

• Determining whether documents prepared or processed through MyOnboarder meet legal, regulatory, or contractual requirements

• Ensuring proper authorization of signers

• Determining the legal enforceability of any agreement

• Consulting with qualified legal counsel regarding document use and execution


MyOnboarder makes no representations or warranties regarding the legal validity or enforceability of any document processed through the platform.

NO LEGAL RELIANCE

Customers agree that MyOnboarder shall not be relied upon as a system of record for legal execution, electronic signature compliance, or evidentiary certification.

Use of MyOnboarder for document workflows does not replace or substitute for legally recognized electronic signature platforms where such compliance is required.

LIMITATION OF LIABILITY RELATED TO DOCUMENTS

To the maximum extent permitted by law, MyOnboarder shall not be liable for any claims, damages, disputes, losses, or legal actions arising from the preparation, signing, execution, or enforcement of documents processed through the platform.

All such responsibility rests solely with the customer.

Content Ownership

All courses, onboarding flows, training materials, and other content created within a company’s MyOnboarder.com account, including content generated using the Instant Course Creator, are owned by the account owner or organization.


Content created within a customer’s MyOnboarder.com account remains the property of the customer, but access to such content is provided only while the subscription is active.


MyOnboarder.com does not claim ownership of customer content and uses such content only to provide the service.

6. Payments & Billing

MyOnboarder collects payment only from Companies (Admins/Owners). End-users invited to join a Company's workspace do not pay MyOnboarder directly.

Payments are billed as described in your subscription plan. Nonpayment may result in account suspension. Customer is responsible for all fees due for the initial term regardless of usage or payment method status

Starter and Pro Monthly Limits

Starter and Pro plans include a fixed number of onboardings per monthly billing cycle. Starter includes up to 10 onboardings per month. Pro includes up to 25 onboardings per month. Unused onboardings do not roll over.

Additional Onboardings

Each paid plan includes a monthly onboarding allocation. Any usage above this allocation is billed as additional onboardings. Starter and Pro plans are billed at a rate of $10 per additional onboard. Enterprise plans use volume-based pricing determined by team size, onboarding frequency, and customization requirements. Rates may vary by tier or usage level. Additional onboarding charges are billed automatically through the customer’s payment method on file.

Definition of an Onboard

For billing and usage purposes, an onboard is defined as any individual who submits a registration through your MyOnboarder registration link or onboarding portal, regardless of whether the individual completes the onboarding flow, interacts with training modules, receives a certificate, or abandons the process at any stage.

An onboard is counted at the moment of successful registration submission and is not dependent on course progress, activity level, or completion status. All onboard counts apply per individual registrant and are recorded immediately upon registration.

Plan Upgrades

Customers exceeding their monthly onboarding capacity multiple times may be prompted to upgrade to a higher plan tier that better aligns with their usage. Upgrades can be completed directly in the billing section and take effect immediately.

Launch Window and Delayed Billing

Some subscription plans include a guided launch period. For these plans, a valid payment method is required at signup to reserve onboarding capacity, but charges may not be processed immediately.


Billing begins fourteen (14) days from signup, unless MyOnboarder extends the launch window in writing.


The launch window begins when the customer submits payment details and schedules their discovery call.

Delays caused by customer inaction, including missed calls, failure to provide required materials, or delayed approvals, do not pause or extend the launch window.

If delays are caused by MyOnboarder, billing will be reasonably adjusted.

Initial Term

Certain subscription plans include an initial commitment period. For these plans, the initial term is six (6) months beginning after the launch window. After the initial term, the subscription continues on a month-to-month basis unless canceled with thirty (30) days’ notice.

Plan Limits and Automatic Upgrades

Each subscription plan includes defined limits for active users and onboardings per billing period. If a customer attempts to increase usage beyond the limits of their current plan, the subscription will require an upgrade to a plan or tier that supports the increased usage. Any such upgrade will be clearly disclosed in advance and requires user authorization before charges are applied. Approved upgrades take effect immediately and may be prorated for the remainder of the billing period. Subscription pricing is based on the highest plan or tier authorized during the billing period. Plan limits, usage definitions, and upgrade behavior are described on the pricing page and within the application.


Instant Course Creator Usage

The Instant Course Creator is intended for internal team training and onboarding use.

Typical usage for most customers falls within a reasonable annual range based on team size and onboarding activity. While MyOnboarder does not enforce strict per-user quotas at the point of purchase, usage that significantly exceeds normal internal training patterns may require a plan adjustment.

Examples of usage that may require review include, but are not limited to:

  • Large-scale external course distribution
  • Use of the platform as a primary course-selling or LMS business
  • High-volume course access significantly beyond internal team needs

If an account approaches or exceeds reasonable usage levels, MyOnboarder may notify the account owner and provide options, including upgrading to a plan that better supports that level of activity.

MyOnboarder will not retroactively charge for past usage without prior notice. Any required upgrades or adjustments will be clearly communicated and require approval before billing changes take effect.

Plan Abuse and Fair Use

MyOnboarder reserves the right to enforce fair-use protections if onboarding usage exceeds the intended volume of the selected plan, including upgrading the account, restricting access to certain features, or pausing new registrations until the account is in compliance.


MyOnboarder is designed to support legitimate onboarding and training activities. To ensure reliable performance and fair access for all customers, use of the platform is subject to reasonable use limits, which may apply to onboarding volume, active user access, training activity, document uploads, and other usage patterns that materially impact system performance or cost.


If usage exceeds what is considered normal or intended for the subscribed plan, MyOnboarder may apply reasonable restrictions or require the purchase of additional credits or a plan upgrade. Any such purchases or upgrades will be clearly presented for administrator approval prior to billing. MyOnboarder does not apply automatic or surprise overage charges without explicit administrator consent.


Plan limits and feature availability may vary by plan and are subject to change. Continued use of the platform constitutes acceptance of these reasonable use policies.

Upgrades

If you upgrade your plan during an active billing cycle, the new onboarding limits apply immediately and prorated charges may be applied. Upgrades do not retroactively adjust past onboarding counts.

7. Data & Privacy

MyOnboarder does not store data long-term outside what is necessary for temporary system operations. Any retained data is stored securely and processed in compliance with GDPR, CCPA, and industry-standard privacy protections.


We never sell personal data. We do not share mobile information with third parties for marketing.


You agree that MyOnboarder may send:

  • System notifications
  • Password resets
  • Training reminders
  • Account-related updates
  • Product updates

Data Retention After Downgrading

If you downgrade from any paid plan to the Free Plan, your account data, onboarding records, uploaded documents, training progress, modules, and custom configurations will remain stored on our servers for up to one year. During this period you may restore full access at any time by upgrading to a paid plan.


If no upgrade occurs within one year of downgrading, MyOnboarder reserves the right to permanently delete all stored data associated with the account. Data deletion is irreversible and may include documents, workflow settings, onboarding history, analytics, user activity, and all custom materials.


MyOnboarder is not responsible for data loss resulting from a voluntary downgrade, expiration of the retention period, or failure to maintain an active paid subscription.

8. Intellectual Property

MyOnboarder retains all rights to:

  • Platform code
  • AI roleplay technology
  • DocuGrader
  • Auto-detection tools
  • Templates, UIs, and branded materials

You may not copy, resell, or redistribute any part of the platform.

9. Limitation of Liability

To the fullest extent permitted by law:

  • MyOnboarder is not liable for any indirect, incidental, punitive, or consequential damages.
  • MyOnboarder's total liability under these Terms will not exceed the amount paid by the Company during the last 12 months.
  • The platform is provided "as-is" without warranties of any kind.

Companies and Users assume full responsibility for how they use the system.

10. Modifications

We may update these Terms occasionally. Continued use after updates means you accept the new Terms.

11. Governing Law

These Terms are governed by Wyoming law, without regard to conflict-of-law rules.
